This is, in my opinion, one of the most controversial rules in Sasuke. Is it fair to say a competitor failed just because he touched the water, but didn't fall into the water?

Well the water is considdered off the course. would it be fair if in the old stage 2 you climbed up and across the scaffolding to get to the Spider Walk instead of using the Brick Climb? nope. Granted I would have liked to see how far these people really can go especially the people who lost like that and don't or might not come back. But I think by the rules its fair.

heck just ask Akiyama who barely skimed the water on the sextuple step cutting his dream short that year.. Shingo dangling on obstacles hitting his toes in the water because of his gangly legs.. that given.. they knew ahead of time you don't go touching water. it's there fora reason.. and not only to catch your body when you fall

Yeah it's fair. I can't think of any examples where it's difficult not to touch the water in Sasuke. Think of the stepping stones in Takeshi's Castle.
